Settlement Agreements
Pre July 2013 these used to be called Compromise Agreements.
A Settlement Agreement is entered into between an employee and employer to record and implement terms that have been agreed. They are most common upon the termination of employment but can be used at any time during the course of employment as well.
Employees have various rights in accordance with common law, statute and their contract. By signing a Settlement Agreements these rights are being waived, usually in return for a sum of money payable by the employer. It is therefore vital that legal advice is sought on the terms being proposed. Indeed for the Settlement Agreement to be legally binding independent legal advice is required regarding the terms and effect of the Agreement. It is common practice for an employer to contribute towards the legal costs of the employee obtaining legal advice.
