What is an accident in public?
Any accident that happens in a place open and accessible to the public, whether indoors or outdoors can be considered a public place accident, also known as public liability accidents. This could involve being injured as a result, for example in an accident in the street, an accident in a shop or your local supermarket, leisure centre or accidents at theme park or restaurants.
To succeed in a public liability claim you must show that the occupiers failed in their duty to take reasonable care and that this caused the injury that was suffered. On occasions some accidents in public places are blameless for example if you were not paying attention and walked into a sign. However, if that accident could have been avoided by the land or business owner ensuring the area was safe you may be entitled to claim compensation for your injury.
